GENERAL INFORMATION
1.1. Hero Fit Challenge is the legitimate owner of all commercial rights related to the Hero events, including all related trademarks, designs, logos, and trademark rights
1.2. Hero Fit Challenge occur through a series of events held in different cities within the National Territory (Portugal) and other countries.
1.3. The categories in which participants may register for each event are:
Doubles Categories:
HERO MALE DOUBLES
HERO FEMALE DOUBLES
HERO MIXED DOUBLES
Participants can register for more than one category; however, they must ensure they can compete in all categories due to the scheduling of competitions and start times for each category.
1.4. Registration for the events must be done exclusively online through the following website: https://www.hero-challenge.eu
These Terms and Conditions (T&C)
2.1. These Terms and Conditions (T&C) govern the legal relationship between Hero Fit Challenge and the user, as a participant (“Participant” or “user”) or purchaser of tickets to participate in the events. You agree to adhere to these T&C by accepting them at the moment you submit your ticket purchase request for the event. By clicking the corresponding checkboxes, you confirm that you have read and accepted these T&C for each event in which you intend to participate, although these T&C will only become valid after your successful registration in the event. No participant may participate in an event held in the Territory without accepting these T&C.
2.2. Hero Fit Challenge may modify these T&C at any time, and such modifications will be considered valid if you do not inform Hero Fit Challenge that you disagree with the proposed modifications within seven (7) calendar days from the date of communication from Hero Fit Challenge.
PARTICIPATION CONDITIONS, EXCLUSION, AND DISQUALIFICATION
3.1. Any person may participate in the Events if:
(1) on the date of the Event, they are at least 16 years old;
(2) they are in good health and physical condition;
(3) they are properly registered for the Hero Fit Challenge as mentioned in clause 3.4;
(4) they accept these Terms and Conditions, the Privacy Policy, and the REGULATION specified in the links available on the Registration Site;
(5) they are credentialed according to clause 7 or have an official competition number.
3.2. If the Participant is under 18 years old on the date of the Event, it is necessary to present a written consent declaration from their legal guardian along with the registration. This declaration must be signed and sent via email to info@hero-challenge.com along with a copy of the identification document of the parents or legal guardian. If a valid authorization is not presented to the organization before the Event, the Participant must provide a valid authorization upon entry to the Event venue. If a valid authorization is not presented at that time, the Participant will not be allowed entry and will be disqualified from the Event.
3.3. Each Participant is responsible for assessing whether they are in adequate physical condition and good health to participate in the Event, and should consult a physician if in doubt.
3.4. The requirements for proper registration for the Events include:
(1) the purchase of a ticket to participate in an Event by paying the registration fee and all applicable fees;
(2) the assignment of the ticket to the person who wishes to be a Participant in an Event, which must be done online by providing complete and truthful information through the registration form on the Registration Site;
(3) the acceptance, by each Participant, of these Terms and Conditions, the Privacy Policy, and the REGULATION, as stipulated on the Registration Site.
3.5. Hero Fit Challenge reserves the right to disqualify and/or exclude a Participant from an Event at any time if the Participant has provided false information regarding their personal data in the registration. Furthermore, Hero Fit Challenge has the right to exclude and/or disqualify Participants who do not comply with these Terms and Conditions, the Privacy Policy, or the REGULATION, as well as any other instructions communicated by Hero Fit Challenge before, during, and/or after the Event. Hero Fit Challenge may communicate additional instructions through its duly appointed employees, as well as medical personnel supervising the Event, who may prohibit Participants from continuing to participate for their own protection.
3.6. Hero Fit Challenge reserves the right to disqualify and exclude Participants from the Event at any time and without refund of the entry fee and service fee if there are sufficient suspicions that the Participant has used substances not authorized by competent authorities or performance- enhancing substances.
REGISTRATION AND CONTRACT CONCLUSION
4.1. Registering for an Event on the Registration Site does not, by itself, create a contractual relationship between the Participant and Hero Fit Challenge, nor does it represent a binding offer from Hero Fit Challenge. A binding contract is formed only upon the successful completion of the registration process and the assignment of a personalized ticket.
4.2. The Participant must select the category in which they wish to participate at the time they register. After completing the process, they must accept these Terms and Conditions, the Privacy Policy, and the REGULATION.
4.3. The Participant is responsible for the accuracy of their personal information.
4.4. Once the registration is completed, the Participant will receive a confirmation email. If errors are found, the Participant must inform Hero Fit Challenge immediately.
4.5. Registration is confirmed when the Participant receives a Positive Registration Confirmation Email. If registration is rejected, the ticket purchaser will be refunded the amount paid, minus service fees.
PRICES, SERVICE FEES, AND PAYMENT CONDITIONS
5.1. All prices on the Registration Site include the applicable VAT.
5.2. The service fee will be displayed before payment.
5.3. Payment must be made through the online platform using accepted methods: Visa, Mastercard, American Express, Google Pay, and Apple Pay.
5.4. If payment is canceled or fails, Hero Fit Challenge may terminate the agreement and charge a processing fee of €10.00 plus tax and any applicable bank fees.
CONTRACT ADAPTATION – REGISTRATION MODIFICATION
Refunds are excluded under normal circumstances, except as outlined in Clause 8. If changes are needed:
6.1. You may modify your registration up to one week before the event by contacting customer service via email at info@hero-challenge.eu
6.1.1. change a participant, provided the division remains the same (gender change is not allowed).
6.1.2. change both participants competing, provided the division (duos) remains the same (gender change is not allowed).
CREDENTIALING
7.1. Credentials will be sent via email and must be presented along with ID (national identification card, driver’s license or passport) upon arrival.
7.2. Participants are responsible for verifying the accuracy of their badges.
EVENT CANCELLATION/POSTPONEMENT/PARTICIPANT NON-ATTENDANCE
8.1. Hero Fit Challenge reserves the right to cancel or postpone an Event due to force majeure, including government restrictions, or insufficient participation.
8.2. If the Event is postponed or canceled, Participants is entitled to a voucher valid for 12 months, for any alternative Event promoted by Hero Fit Challenge.
8.3. If the postponement or issuance of a voucher is unacceptable to the participant, a refund of the registration fee (excluding service fees) will be provided.
8.4. Hero Fit Challenge is not responsible for any other costs or expenses incurred by the Participant due to the postponement or cancellation of the Event.
8.5. If the Participant does not attend the Event, regardless of the reason, they will lose any right to a refund from Hero Fit Challenge.
RIGHT OF WITHDRAWAL
9.1. You have the right to withdraw from the contract within 14 calendar days from the date of payment, without providing any justification or incurring any penalty, provided that the event is not scheduled to take place within that 14-day period. If the event is scheduled to occur within this 14-day period, you may still exercise your right of withdrawal up to one day before the event, but you must ensure that your withdrawal request is received in time as per Clause
9.2. To exercise your right of withdrawal, you must send an email to info@hero-challenge.eu including your personal details, a clear statement of your decision to withdraw from the contract, the date of payment, and proof of payment. This email must be received at least one full business day before the event to be processed in time.
9.3. Once the right of withdrawal has been exercised, your registration will be canceled, and any access to the event will be invalidated. Any amounts paid will be refunded, except for bank processing fees where applicable.
LIABILITY, LIMITATION, AND EXCLUSION OF LIABILITY
10.1. Participation in the Event occurs at the Participant’s own risk.
10.2. To participate in the Event, Participants must be healthy and in good physical condition.
10.3. By registering for the Event, each Participant expressly declares that they are aware of the specific dangers associated with the Event and that they do not have health issues.
10.4. In case of slightly negligent non-compliance with essential obligations by Hero Fit Challenge, its liability is limited to the damages actually caused and foreseeable. Hero Fit Challenge will not be liable for slightly negligent non-compliance with secondary obligations. In this context, essential obligations are those whose performance is essential for the proper implementation of these Terms and Conditions.
10.5. Hero Fit Challenge is not responsible for the loss of clothing, valuable items, and equipment belonging to Participants. If Participants hand over their belongings to Hero Fit Challenge for safekeeping, it will be responsible only in cases of intentional misconduct or gross negligence.
10.6. To the extent that Hero Fit Challenge liability is excluded or limited, this exclusion or limitation also applies to the personal liability of its employees, collaborators, team members, representatives, and auxiliary agents.
COLLECTION AND PROCESSING OF DATA
11.1. The Participant agrees that the personal data provided in the registration form will be stored and used by Hero Fit Challenge and its partners and/or suppliers for the proper execution of the Event.
11.2. The personal data provided by each Participant during registration will be stored and processed by Hero Fit Challenge or by service providers contracted for the conduct and management of the Event, including medical assistance. The processing of personal data is carried out in accordance with the provisions of the General Data Protection Regulation. The data is primarily stored to facilitate the processing of the registration payment; all communication related to the Event with the Participant will occur exclusively via email.
11.3. Personal data will be used and transferred only for purposes related to the Event, and will be stored for a period of up to 12 months following the event, or longer if required by law.
11.4. The timing device (“Chip”) must be returned to the person responsible for Hero Fit Challenge immediately after the conclusion of the race in the finish area. If the device is not returned, Hero Fit Challenge will charge the Participant a fee of 80.00 euros.
11.5. If the Participant performs a pre-check-in the day before the Event, Hero Fit Challenge will provide the Chip at that time. If the Participant attends the Event without the Chip, they will not be able to participate and will have to pay a fee of 80 euros.
11.6. The Participant agrees that the following data: their name, registration number, results, and position in the Event will be published in all digital (or printed) media related to the Event, as well as in all electronic means of Hero Fit Challenge.
11.7. If the Participant has registered for Hero Fit Challenge mailing list, they will be regularly informed about news, training, and offers for the Event, with the consent of the Participant during the registration process. Participants can unsubscribe from this newsletter or withdraw their consent at any time.
11.8. The Participant has the right to receive free information about their stored data and, where necessary, the right to correction, blocking, or deletion of such data. For further questions regarding the collection, processing, or use of their personal data, the Participant should contact Hero Fit Challenge via email, to info@hero-challenge.com
PHOTOGRAPHY/RECORDING AND IMAGE RIGHTS
12.1. Hero Fit Challengeinforms that the Event will be recorded in its entirety, covering the official competition, as well as pre- and post-competition phases (athlete area, technical briefing, starting/warm-up area, competition area, entertainment area, awards ceremony), through photographs and audio/video material. The company responsible for the recordings and Hero Fit Challenge will store the recorded material and use it for informational and marketing purposes in any medium, without time and space restrictions, as well as allowing official partners/sponsors to use it freely. The Participant explicitly accepts the use of their images in the context of conducting the Event. Additionally, the company responsible for the recordings may use the images for its own benefit and offer the sale of such material to Participants who wish to acquire photos or videos in which they appear.
12.2. In any situation, Hero Fit Challenge will respect the rights of each Participant. Individual photographs and audiovisual material of Participants in connection with the Event, for example, during the awards ceremony, will always be considered as classic competition photographs of the Event, and Hero Fit Challenge will have the right to use such material.
12.3. Hero Fit Challenge guarantees that the material obtained will be used solely in connection with the Events, even if it is passed on to authorized third parties.
12.4. Hero Fit Challenge has the right to store, use, transmit, execute, duplicate and/or publish all material obtained at the Event. This also includes the right to make changes, edits, interruptions, deletions, or other modifications to the material and use it without restrictions. Furthermore, Hero Fit Challenge is authorized to transfer these rights to third parties freely.
12.5. The Participant does not have the right to approve the content of what Hero Fit Challenge publishes, nor to be mentioned as a Participant, or to receive financial compensation in case of being mentioned or illustrated, or for the reproduction of any audiovisual material obtained during the Event.
